Article 1: Definitions
1.1 In these General Terms and Conditions “Vintagonist” means the V.o.f., registered in the trade register of the Chamber of Commerce in Amsterdam, with Chamber of Commerce number 34144449.
1.2 Customer means any visitor to the webshop, natural or legal person, who places an order via Vintagonist.com.

Article 2: Applicability
2.1 These General Terms and Conditions apply to all orders placed through the webshop bestwelhip.nl
2.2 By placing an order, the customer accepts the applicability of these General Terms and Conditions.
2.3 These General Terms and Conditions can only be deviated from if this has been expressly agreed in writing and in which case the other provisions of these General Terms and Conditions remain in full force.
2.4 Vintagonist.com reserves the right to change or supplement these Terms and Conditions from time to time.

Article 3: Agreement
3.1 An agreement is concluded when an order confirmation from a customer has been sent by e-mail to the e-mail address specified by the customer. As soon as the order is confirmed by e-mail, the customer and Vintagonist.com have a valid agreement. To the extent permitted by law, this electronic confirmation serves as a presumption of evidence.

3.2 Only orders with a clear name, address and telephone number will be processed.

3.3 Reserved items are held for a maximum of 10 days. After these 10 days, reserved items are put up for sale again, unless otherwise agreed in writing.

Article 4: Personal data
4.1 The data provided by the customer will be treated confidentially by Vintagonist.com and used for the following purposes:
– Processing the order, payment thereof and delivery to the correct delivery address
– Promote the user-friendliness of the webshop
– In the future provide any information about new updates, possible offers and newsletter (if the customer has chosen)

Article 5: Offer
5.1 Vintagonist.com sells often used items (vintage), any traces of use cannot be excluded. This is part of the product. Without requesting further information, you agree to the condition of the item.

5.2 Information, description, photos / images, verbal, telephone or e-mail messages provided by Vintagonist.com with regard to the offer are given or made as accurately as possible. However, Vintagonist.com does not guarantee that all offers and products are fully in accordance with the information provided, etc. In principle, deviations cannot lead to compensation and / or dissolution of the agreement. If the product clearly deviates from the information on the website, Vintagonist.com will take appropriate measures to accommodate the customer.

5.3 Vintagonist.com often sells the lighting with the original wiring that does not always (anymore) meet the current rules / standards. Vintagonist.com recommends that you consult an electrician before use. Vintagonist.com sells the lamp excluding light bulb, unless explicitly stated otherwise.

5.4 Vintagonist.com can not be held to its offer if the customer, in terms of reasonableness in social views, should have understood that the offer contains an obvious mistake or error.

5.5 Because products cannot be automatically removed from the site after ordering, it is possible that a product can be ordered / requested by two customers at the same time. If this happens, the product is sold to the person who ordered the product first.

Article 6: Prices and Payments
6.1 All prices stated by Vintagonist are expressed in Euros. All prices exclude shipping costs.

6.2 99% of the items offered are margin items (not VAT items) and fall under the margin scheme. For margin items, no VAT is stated on the invoice. VAT is therefore not deductible. If you want to know whether an item is a margin or VAT item, you can request this by email.

6.3 Orders via the website can be paid in the following ways:

– Cash payment when you pick up the order (this is done by appointment, in consultation with the customer)
– Payment in advance by bank transfer; the customer transfers the amount due, including shipping costs, to bank account 1187.51.042 in the name of. Vintagonist in Amsterdam, stating the item description. The amount due must be credited to the relevant bank account within a maximum period of 7 days. If this term is exceeded, the agreement will be automatically dissolved by Vintagonist.

6.4 The product will not be shipped until the full total amount has been credited to the bank account. Once an item has been ordered, it will be listed as “reserved”. If the payment is not received 5 days after ordering, the item is put back on sale.

6.5 Vintagonist.com expressly reserves the right to change prices, especially when required by (legal) regulations.

6.6 Special offers are only valid for the period of validity as stated on the website in relation to that special offer.

Article 7: Shipping costs
7.1 Shipping costs in the Netherlands: rates according to TNT Post, these are stated on the website or can be requested via the contact form of Vintagonist.com

7.2 Depending on the weight, a different rate is charged for shipping abroad. To do this, you must first contact Vintagonist.com by email

7.3 Typing errors and errors in the calculation of the shipping costs reserved.

7.4 If the customer is not in the country of dispatch, the customer is liable for any turnover tax and / or import duties owed.

Article 8: Delivery
8.1 Collection of the goods is only by appointment, this will take place in consultation with Vintagonist.com. Especially in the case of fragile items, pick up is preferred!

8.2 Vintagonist initially delivers only within Europe. For orders from abroad, you must first contact us by email about the amount of the shipping costs. Different delivery terms and conditions apply to deliveries abroad.

8.3 The articles are packed as good as possible for shipment. However, if damage occurs during shipping, Vintagonist.com is not liable for this.

8.4 Upon receipt of payment, Vintagonist sends the order within seven working days. The stated delivery time is indicative and never counts as a deadline. Exceeding any delivery period does not entitle the customer to compensation or the right to cancel the order or dissolve the agreement, unless the delivery period is exceeded in such a way that the customer cannot reasonably be expected to maintain the agreement. late.

8.5 Delivery takes place at the address specified by the customer during the conclusion of the agreement.

Article 9: Retention of title
9.1. Ownership of the products already transfers when the products are offered at the delivery address specified by the customer. If the customer fails to receive the products, the resulting damage and costs are for his or her account. Any returns to Vintagonist.com are for the account of the customer.

Article 10: Return
10.1 If desired, an item can be returned at the expense of the customer. This must then be reported immediately after receipt by e-mail. Returns can be sent within 7 days after purchase / receipt of the item, only if the item is in exactly the same condition / condition as when it was sold. Costs incurred for sending to the customer and / or returning or returning items are for the account of the buyer.

10.2 The purchase amount will be returned after the process of article 10.1 has gone well.

10.3 Vintagonist.com reserves the right to refuse returns or to refund only part of the amount if it is suspected that the products have been used or damaged by the customer or third parties.

Article 11: Intellectual property
11.1 The customer expressly acknowledges that all intellectual property rights of displayed information, images / photos, announcements or other expressions with regard to the products and or with regard to the internet site or promotion thereof are vested in Vintagonist or other entitled parties. Photos, images from Vintagonist.com should not be used without permission.

Article 12: Force majeure
12.1 If one or both parties are hindered as a result of a circumstance that is not due to fault, force majeure, both parties are not obliged to fulfill any obligation.
12.2 Parties can suspend the obligations under the agreement during the period that the force majeure continues. If this period lasts longer than 2 months, each of the parties is entitled to dissolve the agreement, without obligation to pay compensation to the other party.

Article 13: Damages
13.1 Vintagonist.com can only be held liable for damage that can be attributed to its intent or fault, or is caused by circumstances that are based on its risks.

13.2 Vintagonist.com is not liable for damage caused by third parties or for consequential damage due to misuse or a defect that cannot be foreseen by Bestwelhip.

Article 14: Applicable law and competent court
14.1 All rights, obligations, offers, orders and agreements to which these General Terms and Conditions apply are exclusively governed by Dutch law.
